DMCA Policy

Guide respects intellectual property rights and expects its readers to do the same. This page explains how to notify us of claimed copyright infringement and how to respond if your material was removed in error, following the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Our content

Articles on this site are original work. We quote official sources — statutes, regulations, and agency guidance, which are generally public-domain US government works — with citation and links. If you believe we have used protected material improperly, tell us using the procedure below and we will act promptly.

Filing a copyright infringement notice

Send written notice to support@guide.upcomingscreen.com with the subject line “DMCA Notice”. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at one site, a representative list).
  3. Identification of the material claimed to be infringing, with enough detail for us to locate it — the full URL of the page and the specific passage, image, or element.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may delay our response. If you are unsure whether the use is infringing or is permitted (for example as fair use), you may wish to seek legal advice before filing — we cannot advise you on that.

What happens after we receive a valid notice

We review promptly and, where the notice is valid, remove or disable access to the material expeditiously. We will make a reasonable effort to notify whoever posted it, along with a copy of the notice.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to support@guide.upcomingscreen.com with the subject “DMCA Counter-Notice”, including:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the complaining party or their agent.

We may restore the material in 10 to 14 business days after receiving a valid counter-notice unless we are informed that the complaining party has filed an action seeking a court order.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please do not use this process to remove criticism, competing information, or content you simply dislike.

Repeat infringers

We terminate access for repeat infringers in appropriate circumstances.
